  • Transaction Information: When you purchase a ticket, we collect your name, billing address, and payment information (such as a credit/debit card number). Note: Full payment information is processed securely by our third-party payment processor; we do not store your full card number.

  • Organizer Information: If you are an Event Organizer, we collect additional information, such as your legal business name, address, and bank/payout account details.

  • Communications: When you contact us for support or send us a message, we collect the information you provide in your communications.

B. Information We Collect Automatically:

  • Usage Data: We automatically collect information about how you access and use the Service. This includes your IP address, browser type, device type, operating system, pages you viewed, the time and date of your visit, and the links you clicked.

  • Cookies and Trackers: We use cookies, web beacons, and similar tracking technologies to operate and personalize our Service. This helps us remember your preferences, secure your account, and analyze site traffic. You can control the use of cookies at the browser level.

C. Information from Third Parties:

  • We may receive information about you from third-party services, such as social media platforms, if you connect them to your Yayatoh account.

  • To Provide and Manage the Service: To create your account, process your ticket purchases, facilitate event creation for Organizers, and issue payouts.

  • To Communicate with You: To send you transaction confirmations, receipts, service updates, security alerts, and support messages.

  • To Share with Event Organizers: When you purchase a ticket, we share your basic information (such as your name, email, and ticket type) with the Organizer of that event so they can manage check-in and communicate event-specific information with you.

  • For Marketing: To send you promotional messages about new events and features, only with your consent where required by law. You can opt-out of marketing communications at any time.

  • To Comply with Legal Obligations: To meet our legal, tax, and regulatory requirements.

  • To Protect the Service: To detect and prevent fraud, abuse, and security incidents.

  • To Analyze and Improve: To understand how our users interact with the Service so we can improve it.

 

4. How We Share Your Information

We do not "sell" your Personal Data in the traditional sense. However, we do share it in the following limited circumstances:

  • With Event Organizers: As stated above, we share your information with the Organizer of the event you are attending. We are not responsible for how Organizers use your data.

  • With Service Providers: We share information with third-party vendors who help us operate our Service, such as payment processors (e.g., Stripe), cloud hosting providers, and email service providers. These vendors are contractually bound to protect your data and only use it for the services we request.

  • For Legal Reasons: We may disclose your information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.

  • In a Business Transfer: If Yayatoh is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

 

5. Data Security

We implement reasonable administrative, technical, and physical security measures to protect your Personal Data from unauthorized access, use, or disclosure. However, no internet transmission is 100% secure, and we cannot guarantee its absolute security.

We retain your Personal Data for as long as is necessary to provide the Service to you and to fulfill the purposes described in this policy. We will also retain data as required to comply with our legal obligations (e.g., tax and accounting), resolve disputes, and enforce our agreements.

 

7. Children's Privacy (COPPA & MODPA)

Our Service is not directed to individuals under the age of 18.

  • Under 13: We do not knowingly collect Personal Data from children under 13. If you are a parent and believe we have collected data from your child, please contact us at info@yayatoh.com to have it removed.

  • Under 18 (Maryland Law): We do not knowingly "sell" the Personal Data of any consumer under the age of 18, nor do we process their data for targeted advertising.

Depending on your location, you may have specific rights regarding your Personal Data.

A. All Users:

  • Access and Update: You can review and update your account information at any time by logging into your account settings.

  • Marketing Opt-Out: You can unsubscribe from our marketing emails by clicking the "unsubscribe" link in the email.

B. Rights for Maryland Residents (under MODPA):

MODPA provides special protections for "Sensitive Data," which includes data revealing racial or ethnic origin, religious beliefs, health information, sexual orientation, or precise geolocation.

We do not "sell" Sensitive Data. We will not process your Sensitive Data for any purpose other than what is strictly necessary to provide the Service you requested, unless we first obtain your explicit consent.
